Where your rights violated? If so, What Should You Do?

Your at a park down the street from your house. Park police pull up and ask for id's b/c its dark and there were breakins in the area. You give him the ID and then he calls MD police. They show up and tell you that there is a warrant from 3 yrs ago for you in Virginia. You arent merandised and you are arrested with no charge. No Miranda is read. The time is 1am on Monday. It is now Wednesday, Virginia has not shown up, Maryland has booked you based on Virginias warrant from 3 years ago. You waived your right so that you can be extradited to the other state. But no one is showing up. Still no rights read to you. You have no bond availability in Maryland b/c you arent formally charged there. You cant get bond until you go to Virginia. Which still hasnt shown up. What should you or could you do? Were you violated? Are you still being violated?

  1. Contact an attorney. Granted it takes some time to get the paperwork done.

    If you ask for an attorney,the police have to get you one.It used to be that you could be held for 24 hours without any charges (72 hours on weekends and holidays) being filed then they had to let you go,but they could also wait until you walked out of the building and pick you up again on the steps.

    Not a big deal.  If you cannot do the time - don't do the crime.

    The police did their job correctly - except for not using their tasers.

  4. You are not uninformed you have a warrant they will tell you what the warrant is for. Although some on You know what it is for.

    Rights do not have to be read No one is questioning you.

    No rights are being violated VA will come get you when they get ready to come get you They do not RUSH they know you ain't going anywhere

    i am taking for granted you are writing this about a friend or loved one?/ cause if it was you then you would not be posting last I checked MD jails do not have internet I been to enough of them

    Do the right thing get him a lawyer that can speed this up and get things rolling

    and get him some money cause they will likely not have him see a judge for 30 days after he gets there.

    LOL No one goes anywhere with a warrant on them they are there until they see the judge who signed that warrant Time should be within 30 days

  5. No you've not been violated you broke the law.

  6. First, as to Miranda.  They do not need to read you the Miranda warnings, those only apply if you are being interrogated.  Being asked guilt seeking questions.

    Second, most parks officially close at sunset and it is common practice to ID people in the park at night.  If you have warrants you will be arrested.

    Third, Maryland is not violating your rights because they are holding you on "good faith" based on Virginia's warrants.  Virginia verified the warrants and indicated they were going to extradite you.

    Fourth, extradition can take a while to place all of the paperwork in the right bins for the judge's signature.  I have made extradition trips to pick up fugitives, and normally I know about the trips two weeks ahead of time (or more), while waiting for the judge to sign.

    No you were not violated, and you are not still being violated.

  7. Miranda does not need to be given because you arrested.

    CUSTODY + INTERROGATION = MIRANDA.

    It is not uncommon for out of state extradition to take many days for  it to happen.

    It takes a bit to assemble persons and arrange travel.  They may also need to get or be in the process of getting a governors warrant - signed by the governors office to allow extradition.  What you are seeing is normal.

    Go get a lawyer if your not sure.

Your rights were not violated.  It is common to have a no bail hold on an extradiction warrant.  Every State has a policy for holding sister State inmates for transfer in an extradiction matter.  You waived your right to an extradiction hearing, which is a good thing... if you want to get to VA and deal with the warrant as quickly as possible.  

    In CA, inmates scheduled for extradiction are held for only 30 days, IF they waive their right to a hearing.  If they do NOT waive their rights to an extradiction hearing, a governors warrant is required which takes about 3 to 4 months... all in custody with a no bail hold.
