Which car is at fault?

Here is what happened:

Leaving a grocery store there is a large area to pull out onto the street. (Room enough for 3 cars- one to pull into the store, one to turn left onto the street, and one to turn right onto the street) A car is in the lane to turn LEFT, but has the right blinker on. A truck then pulls into the RIGHT lane to turn right and is completely stopped. The car in the middle then turns RIGHT and hits the truck.

Who is at fault? No answers about calling the police or anything, I am just trying to see what other peoples personal opinions are. Thanks for participating!!!!

  1. Well the guy that was in the middle lane is at fault. And since he didn't obey the lane rule (which was to turn left) he would also be cited by a police officer while being ruled at fault for the accident. Double whammy. I know this because the same thing basically happened to me in a grocery store.

  3. The only way I can answer this is based on Texas law concerning operation of motor vehicles. So, it sounds like the accident occurred on private property (the grocery store lot entrance/ exit) so the only vehicle laws that would be in effect are DWI and Financial Responsibility (insurance). The truck had not entered the roadway and was struck while still in the driveway so the accident location would be listed as private property. Considering this, the facts that the driver of the car gave the wrong turn signal and turned from the wrong lane have no bearing on fault strictly concerning motor vehicle law. HOWEVER, civil litigation will consider all those facts (wrong turn signal, turn from wrong lane) and show the car at fault. If I were the officer working the accident I would show on the accident report that in my opinion the car was at fault. I wouldn't be able to cite the driver for anything but I can state my opinion that the car's driver is the one at fault. The insurance companies will generally agree with the officer's opinion and pay out based on that alone. However, sometimes they don't agree with the officer and the drivers end up in civil court.

The car is at fault.  By entering the left turn lane, the driver is commited to turning left.  You can't enter the left turn lane and then decide that it's not the correct way for you.  Signalling does not give the driver the right of way...it is only there to display your intention to other drivers.  If the truck *yields* his right-of-way to the car, that's his decision.

    This reminds me of one person that accidentally entered the freeway.  She gets to the top of the ramp, and stops traffic while she does a 15-point u-turn.  She then drives down the freeway on-ramp.

  6. the car in the middle because the truck was all ready tuning right or mabe the left car cus the car was in the wrong lane

  7. the vehicle that hit the other vehicle should always be at fault in this case it is for sure. even in cases where the vehicle that got hit caused the accident it would still be the person who hit the vehicles fault.
