Question:

Which citizenship for my baby?

I am a US citizen but the donor for my baby is a Japanese citizen. At the time of the birth, can my baby have Japanese citizenship if he/she is born in USA? I travel a lot and use to live in Japan so if I could give the baby Japanese citizenship I would like to move there for the rest of the school years he/she will have. Do I even have a choice? I know that Japan does not support a "duel citizenship".

  1. Your only option in this situation is American citizenship for the baby.

  2. Japan is a particularly interesting case in citizenship.  They have a "registry" and the parents must not only be Japanese citizens, but the mother must be a registered Japanese citizen to confer citizenship on their child if born outside Japan.

Now what's this about "donor?"  You are not married to the baby's father?  Is it a sperm donor?  No right whatsoever to Japanese citizenship.  Where it is born is totally irrelevant.  You, the mother, are not a registered Japanese citizen.

BTW, if you are talking about a sperm donor, how are you ever going to prove who the father is?  Donors are anonymous.  Donors are not liable for child support.  And you really have no idea who the donor is or what his citizenship really is.  No possibility of any claim to any citizenship whatsoever through the father.  And as far as Japan is concerned, even if the father were a Japanese citizen, there is no claim to Japanese citizenship if the mother is not a registered Japanese citizen.
