Which driver would you discern caused this accident? (see image)

Above is the image.

1) The car represented by the red rectangle had flashing red lights.

2) The car represented by the white rectangle had flashing yellow lights.

3) The distance between the red car (stopped at the light) and the yellow car when it first appears is over 500 feet.

4) The image now includes more data than an earlier posting (the time when the red car approached the intersection) to make the event clearer to the viewer. However, it reflects the same data.

  1. it really all depends on where you live, and the amount of damage done. but from the interesting animation, i would have to say that the white car is at fault, because the red car made a full stop and proceeded through the intersection, the white car on the other hand, a yellow blinking light means that they need to slow down to the speed limit or slower through that intersection

I just like the animation, so I'll answer again!  LOl  If it can be proved that the white car accelerated to get through the intersection then I think both vehicles can be assigned some degree of fault.  If not, I say that the RED vehicle is at fault.  A vehicle going through flashing yellow lights is supposed to enter the intersection with caution.  A vehicle entering an intersection with flashing red lights must come to a complete stop and enter the intersection only when it is safe to do so.  If a vehicle enters the intersection (doesn't matter if the red car couldn't see the vehicle or how suddenly the white car appeared, etc.) and an accident results, the red car would have failed to yield.  The red car must make sure that he can enter and complete the intersection safely or he has failed to yield.  Just like if the red vehicle had a green light (must yield to turn left) and wanted to turn left.  The white vehicle comes over the hill but is going straight with a green light and the red vehicle can't see the white vehicle going straight and decides to turn and an accident results.  The red car in that scenario would also be guilty of failure to yield.

    RESPONSE to your comment:  as I said, it doesn't matter how far away the other vehicle is.  Unless you can prove that the white car sped up through the intersection, the red car would have failed to yield.  I have investigated many accidents.  My guess is that you are the red car and can't believe that the accident is being put on you.
