  1. That depends on a bunch of different things, for instance, where your spouse is coming from. If you marry and file the I-130, then your case will be handled in an embassy in the country where your spouse lives. The Philippines and Mexico both have pretty long waiting lists, so, if she's from one of those countries, the fiance visa would work better.

    My husband and I opted to do the spouse visa way as he was Canadian and wanted to be able to work in his home country. So, we got married, and then filed. He was able to stay over there working right up until his interview at the embassy and he got his temporary green card stamped into his passport. So, when he came across the border, he could immediately look for a job. If you do the fiance visa, it'll be awhile before your spouse can work. You'd file the I-129f and once you were married, you'd file the I-485 concurrently the Affidavit of support I-864 along with I-131 and I -765 to be able to work and travel briefly outside the country. It may be as long as 90 days after before you are able to get employment authorization..  You'll eventually get scheduled for an interview to establish the validity of your relationship. Then, within 90 days the 2 year expiration, you'll have to file the I-751 to remove the conditions..

    If you marry first, then you will have to live apart for awhile, but, both of you can continue to work in your respective countries. If you decide to do it that way, you will file the I-130, hopefully get your approval notice, then you'll be requested to submit the fee for the I-864, then you'll file the I-864. Eventually your spouse will receive the DS230 along with instructions to fill out part 1 only. Then, you'll get an interview date at an embassy in your spouse's country. If that's approved, your spouse's passport will be stamped and returned with the temporary permanent resident stamp. But, when your spouse goes through customs, she must let them know she is moving into the country and show her stamp in her home countries passport. Then, they will have to do some paperwork in the office and she'll have to declare what she's moving across with. That will trigger the sending of her conditional permanent resident card. You'll have to remove the conditions within 90 days before the expiration using form I-751..

    It's hard to say which one is best for your situation. Hopefully that info will help you to decide that.


  2. neither one are fast, but the fiance sponsorship is slightly less longer,

    why? the fiance visa, once you finally get the future wife in the US, and get married, she can stay,if indeed you get married within the required period,

    the other way, seems longer, not quite sure it is?

    many a time couple get married, without the proper paper work beforehand,and then, all the translation, transfer have to be done,

    it takes time,

    while the wife waits abroad.....

Fiance visa is usually quicker.  One issue is that besides longer processing times, the embassies in many nations require certified copies of marriage (birth), etc.  In nations with a national certification office, such as in the Philippines with the NSO, the original city issues a marriage cert (or birth cert) and then sends a copy to the National Office which may take 6 months (for the nation to process in).  As a result a married couple might have to wait six months just to have the certified national copies of the marriage.
