Like if the President were guilty of war crimes & treason, and should be impeached, who would get the ball rolling?

  2. Article 2, Section 4 of the US Constitution states, "The President, Vice President, and all other civil Officers of the United States shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other High Crimes and Misdemeanors."

    First, the House of Representative votes to impeach an officer (including the President).  This requires a simple majority vote.  If the House of Representatives votes in favor of the impeachment, the person is deemed to have been "impeached" (even if they are later acquitted).

    Then the officer is TRIED by the Senate.  To be convicted, they have to be convicted with a 2/3 vote of the senators.  If it is the President who is impeached, the senate trial is presided over by the Chief Justice of the Supreme Court.  While two Presidents have been impeached (Andrew Johnson and Bill Clinton) and neither of them were convicted by the Senate.  If an officer is convicted, the senate can also vote to bar them from holding political office in the future.
