Whiplash claim?

my car was hit from behind by another driver last month (and caused my car to be written off) and i have suffered really bad whiplash. i have been to the hospital twice and also to the doctors twice (who have given me all sorts of medication). I still have pains along my shoulders and the front of my neck (i'm working on computers all day and answering phones and this is really uncomfortable on my shoulders) i still have extremely bad headaches which have been constant since the crash.

i was off sick for 9 days with a sick note from my gp (which i've been told by work i won't be paid for).

does anybody know how much i'm likely to be paid in compensation?

i don't mean to sound greedy at all, its just that my performance at work is suffering and knowing that i won't be paid for that week off is really worrying me as i have bills and stuff to pay, and i now have to buy a new car.

  1. There is no chart that says "soft tissue neck injury gets paid $x.xx"

    Each claim is evaluated on it's own merits.

    The insurance company will not pay as you go. They will settle up with you in a lump sum - once you have been released from the dr and are ready to sign a release that ends the claim once and for all.

    Since you are on the phone at work a lot.....get a head set. Makes a huge difference. My company would not buy me one so I bought it myself. Well worth the money.


  2. I also hit a car from behind, she did not indicate :(( She was not injured or nothing, just in a shock, both the cars were also write off. Five months later my ex-insurance company (who dropped me immediately) told me they paid her over £10.000 in compensation as she suffered whiplash. I could not believe it - even ambulance arrived to the crash scene but did not even take her away, she was absolutely fine. So, there you go, there is figure for you.

  3. Nobody can answer this question for you.   We need to know what state the accident occurred in.

    Just because you were injured does not mean that you are entitled to monetary compensation.  The tort threshold requirements vary from state to state.  Some are verbal, some are monetary, and others require you sustain a "serious" injury.  

    If you are tort eligible, the adjuster will evaluate the claim based on the nature and extent of your injury, treatment and disability.  If your medicals and lost wages are not covered under your own policy(some states mandate PIP coverage), they will be included in the settlement.  

    An offer will not be made until you have stopped treatment, and you need to prove that your current subjective complaints exist.   All allegations need to be documented.
