Who's at fault for an accident on a two way hwy in Oregon with a broken yellow and a solid yellow line?

I was heading home on a two way hwy. I had the broken yellow lines (which I think are my right of way). The other driver had a solid yellow line. He was stopped, waiting to make a left turn across my lane. I saw him waiting and then I saw him begin to make the turn, across my lane. I had no time to stop or slow down much as it was a 55 mph hwy. Then as he begins to turn I realize not only is he a huge truck with a flatbed, he is also pulling a flatbed trailer with farm equip. on it, making him approx 25-30ft in length. I knew at that moment I would smash into him. I tried to veer left (to a farm field of mud) but had no time. The veer left stopped me from hitting him head on (which would of killed my 13 year old daughter and myself. I hit his rear trailor. Totalled my 4 runner (I belive). He kept going to the other side of the street to park his rig(s). He crossed a solid yellow line, not allowing me enough stop time. Who's at fault?

  1. The yellow line doesn't concern whether or not he can turn but whether or not he can pass you.

    Good reaction on your part. Most people don't think quickly enough in a situation like that.

    So, did the police not verify that he was the one at fault? (Which he was.) Were you speeding?


  2. The solid yellow line on his side means no passing.  The broken yellow line on your side meands you can pass.  It has nothing to do with him turning in front of you.  He was at fault.

  4. 100% his fault you have a witness ,there is no way he can clame you were at fault .

  5. The yellow lines don't mean a thing.  You had the right-of-way.  He should not have made the turn without ample space to do so.  He's at fault.

  6. Solid line and broken line does NOT give you right of way.  As another poster say that it just mean you can TRY to pass if it is safe to do so (broken light).

    If the other driver turned into your lane unsafely, then he is at fault.  If you did something unsafely then you are at fault.  PERIOD.

  7. The yellow lines mean nothing in this case, he should be cited for making an unsafe turn.

  8. Who received the ticket? He turned in front of you>what did the police say>Get a copy of the police report> Glade you & your daughter weren't hurt>

  9. Based on what you stated so far, sounds like the other party made an unsafe turn and got into your right of way.

    The solid yellow lines can be crossed if making a left turn. It just means "no passing".
