Who's at fault in this accident?

Conditions: Icy snow-covered roads, limited visibility

I had an SUV tailgating me for 10 miles. Upon trying to stop for a traffic light, I started to slide a bit and I veered to the left as to avoid hitting the car in front of me. My truck ended up coming to a nice slow stop yet my truck wheels were still veered slightly left. All the sudden, the SUV that was tailgating me slammed into the back of me and lunged my truck forward. I did not hit anyone. The rear of my truck is damaged.

The driver who slammed into me has her insurance company hounding me for a statement. I refuse to speak to them. I believe she is trying to blame it on me for one reason or another.

I saw the red light, I began to break and also took precautions as to NOT cause an accident. It was sheer ice on the roads. But the impact felt as if the tailgater did NOT brake. It was a very hard impact.

  1. hello. from your description, it sounds like the 'guy' tailgating you on a snowy road is at fault. I am surprised there is not a legal description (officers whatnot) who make a traffic report. maybe they were lost in the snow too. good luck on this ; }


  2. It's the other driver's fault, because you clearly tried to stop. Your tail lights are working, I assume, so they were given warning that you were stopping.

    You could also blame the city for not salting the roads. But it's a long shot.

  6. In my opinion it is the other persons fault if everything happend the way you said. I would recommend talking with an attorney before giving them a statement once they have that whatever else you say is just wasting your breath. They will record what you say and if it would go to court they would have it. A good attorney will handle it for you or give you advice on what to do.

  11. The person that hit u from the rear - Failure 2 have there vehicle under control ..The driving conditions DICTATE the speed 2 b driving ! DON'T fall 4 the story that u backed into the other driver.{I've heard that b 4 }

  12. If it happened the way you say, the tailgater is at fault.

    Any driver must leave a safe distance from the vehicle in front of them. Also, if you rear end someone it is VERY difficult to prove you were not at fault.
