Who's at fault?

One car is traveling south on a state highway while a bull dozier is doing some work in a driveway running west/east with no warning signs up at all. As the car aproach's the dozier starts backing up and was sticking out partially in the road. The car hits the dozier on the side toward the backend who is at fault?

No speeding was involved either.

  9. I think you're all missing the point. Was there enough time for the car to safely stop? Could the car have taken evasive action? Did the car driver sound his or her horn?

    Before absolution of responsibility, an insurance company will look at all mitigating and aggravating factors.

  10. thats  a tough one,a similar thing happened to me about 10 years ago in the parking lot at my apartment complex where I lived with the landscaper truck,I backed up as they were backing up and we hit each other,they blamed me, I blamed them. I had to pay to fix the little damage to their truck,they paid nothing.

    Hard to really know,unless you call the insurance agency.

  11. It would be the dozers fault because he was backing out and there were no warning devises but at the same time you needed to be ready to slow down because you could see what was going on.

  13. I would have to say the dozier but there are accident investigaters who can tell by just looking at the scene and the vehicles involved!

  14. if it was an open road, i would say the cars.  If it was a hill or a curve, i would say dozier.  They should have had signs up either way.
