Question:

Who's fault is in this car accident?

I was going stright in a my lane, first car cuts me off with signal, second car follows her cuts me off with no signal, I slam on brake, which fails due to the weather conditions. There was cars on either side of my lane, I could not turn away and rear end the second car, which turns to the left then I rear end into the first car. ( front is gone ) I don't believe there is much I could of done, can you guys help me out? Who's fault was it?

  1. Usually when you rear end someone it's your fault. Did you get a ticket? If you did you can go to court and talk to the prosecuting attorney and see if they can drop or lessen the punishment/fine for the ticket.


  2. Well, unfortunately, at least in most states, whoever rear ends the car is at fault. My friend was in a similar situation, He was behind a car when it was raining, she suddenly stops because she sees a pedestrian on the sidewalk, though they were not walking, she slams on her brakes and he tried to stop but the ground was wet. he was said to be at fault and his insurance payed out.

Different states have different fault laws but the short of it is- If you hit the rear end of another car you were traveling too fast and or too close for road conditions to slow down fast enough to prevent the accident. Defensive driving means to expect the car in front of you to stop or turn or do some other stupid thing without notification and you will have enough time to react safely.

    Too bad but it is your fault for either being too close or going too fast behind another vehicle.

    Insurance lawyers will  eat you up on this one.

    you were following to closely to safely avoid the accident. the weather also played a part. you should have backed out before the incident had a chance to happen.

  7. i think it is the fault of the second car, since there was no notification that it was going to enter your lane, but, since its your front and their ends, it may be considered your fault. take it to court and explain it.

  8. by the smith system when ever you hit and object in front of you aka rearending another vehilcle its your fault..did not drive defensively..remember to keep a four second following distance.. seven seconds if its raining...

  9. I don't think everyone read your description carefully. Normally I'd say it's your fault for not allowing enough distance between you and the person in front of you. However, since the other people made a illegal lane change and you can't instantaneously make more space between you and the next person, I'd say it was the fault of the second car (illegal lane change, not leaving enough space).
