Who's fault is this?

Two cars are stopped at a light, one behind the other. A third car slams into the second and pushes it into the first. Does the second car get charged as rear ending the first car, or is it the whole thing blamed on the third car as far as insurance goes?

  1. It is generally the fault of the last car but the damage could also be linked to the second car as it did not maintain a safe distance from the first car!

  3. i would think it would be the last car because there is nothing the second car could do to prevent from hitting the first car once the 3rd car hit them

As far a insurance goes.  The third car will be blamed for rear ending the second car.  But the driver of the 2nd car will be blamed for rear ending the first even though they were on the brake.  This is because the insurance company sees it that the 2nd car was too close to the 1st car to be able to use the brakes adequately to prevent the impact.

  5. Usually they car in the rear is at fault for rear ending the second car. The second car is responsible for the first. The reasoning is usually that the second car failed to maintain a safe distance between them and the first car.

    The officer does have some discretion but unless there are third part witnesses don't expect them to use it. The insurance companies will work it out.

    From my experience your the car in the middle and the third car is driven by either an illegal alien or a drunk driver that has lost his license. Regardless they want have insurance.
