My girlfriends car was hit by a hit and run driver in the state of California. The driver of the vehicle that hit her bailed from their car and fled the scene of the accident. The vehicle was not reported stolen however we are not sure at this time who was actually driving the vehicle. When the police arrived on scene they did retrieve the insurance information from the vehicle. My question is whos insurance covers this accident? will it be claimed against our uninsured motorist on our policy? though I know that uninsured motorist does not cover vehicular damage when the driver has not been positivley I.D'ed OR does the vehicle owners uninsured motorist coverage hit us as they are liable for damages caused by their vehicle? I'm really not exactly sure of how any of this works so any help would be greatly appreciated! Thanks!

  1. did u get his tag?? because that is all u need to file a claim agains his insurance is his car that tag number u got no matter who was driving it hi stil responsable for it so if u got that info of his insurance contact them.......

or ur own insurance .. u could file a claim just pay ur deductible and they will get ur car fix..... in this case because u do not know the other person involve............

  2. If you have the owner's insurance info, then he is not uninsured.  The other "hit and run" owner's liability coverage will pay for the damages.   Since you have a police report, this should be a relatively easy process.

If for some reason there is a delay in the claims process, you can file a claim against your own Collision coverage.  They will then subrogate against the at-fault party's carrier for what they paid out and your deductible if it was not waived.

  3. The insurance on the car that hit you should cover the damage. If not your insurance should cover the damage under uninsured motorist's then they will go after the owner of the vehicle and their insurance company.
