Who can I live with if I get emancipated?

I'm currently 16 and living with my stepmother while my father works in Italy. He is coming home in a few weeks and wants a divorce from my stepmother and is abusive. My father has soul custody of me because my real mother got into some trouble with drugs 2 years ago. If I try to emancipate my father, can I live with my stepmother after my father and her divorce as a "roommate" and pay her rent? I already have a steady job but I do not drive. However my job and school are within walking distance of where we would be living and I make enough to pay for a room and buy my own groceries and necessities. Do you think the court would rule in my favor?

  1. You are old enough to choose which parent you will live with. You don't need emancipation. It is your right to choose. I would almost guarantee the judge would agree.  


  2. If you want to do that, then there's no need to get emancipated.  Just ask the court to give your stepfather custody of you.

  3. Anyone. Emancipation means that you are legally an adult and capable of making your own decisions.
