i am going to divorce my wife as she has left me almost one year for another State. Now there is a particular Affidavit of Service form , thats the notice of Divorce. Someone on behalf of the Plaintiff has to serve that to the Defendent. I wanted to know who can send the Service notice? i cannot personally serve that as i read there. I have no friends or relatives who can serve the notice on my behalf. are there any agency in new york?

  1. From a lawyer.  Any peace officer, police, sheriff, constable, authorized by your state to serve citations.  Also, any private parties authorized by the state such as process servers and investigators.

  2. get a licensed process server. do a seach for your area and i am sure a bunch will come up.

  3. You don't serve an Affidavit of Service - you serve the originating claim (in this case the petition for divorce) and the affidavit of service is attached to show it was served.

And there are process servers that will serve anywhere in your local telephone book.

They'll provide you with the affidavit of service.
