My ex & I have joint custody of our 2 year old son. I have him for 5 days then he has him for 5 days and the 5 days he's gone are complete torture for me... His father's house is a disaster it's beyond a mess there are piles of garbage dirty cloths moldy food empty beer bottles etc etc all over the place there is but a small path way from room to room his kitchen is disgusting and smells like something died in there and the bathroom don't even get me started... I know it's not sanitary nor fit for a child or anyone else for that matter to live in... Also now my poor 2 year old is coming back to me with awful stories saying his fathers new girlfriend is slapping him in the face and locking him in a closet. I tried talking to his father about this and then when my baby came home to me the last time he told me his father screamed at him for telling me those things so I know nothing was done about it.... I'm scared for my child's safety I'm afraid something terrible is going to happen to him if I don't take action soon... Who do I call to report this behavior do I call social services or ??? Please help me get my baby out of harms way before it's to late... Has anyone else ever been in this situation before...??? Any help or advice would be so appreciated thanks!

  1. Here's a number you can call:

1-800-422-4453 push #1 when the machine answers.

You might also call child protective services and have them pay a visit ot the home in question.

  2. you need to get an order of protection against your ex for your son. that will give you 21 days to call child services, and have his home checked. also, you can bring this up to the judge when you see him, and tell him of the squalid conditions in his home, and the slapping, neglect.

that kind of enviroment can actually make your child physically ill. he could put something in his mouth, breathe mold and if it is that bad, how can they watch him while he is there? i would not let him go back until it is resolved. to obtain an order of protection, you go to the courthouse. you will see a judge that day. he will grant it, and you will have 21 days (3 weeks) to figure out what can be done. you don't even need to hire a lawyer nessecarily. i never did. he will come to court in 3 weeks, and you both put your case before the judge and he decides to continue it (for up to 3 years) with conditions, or to deny it. good luck!!! but regardless , i would call child services. if anything you will have a report on the condition of the house, and if you  do lose the order, you might be able to get it to where he oonly has him hours at a time at a different location (mcdonalds, the park etc.)

also, at this time, you can request all that you want. the judge is sitting right there, do what you can. you can request a modification in the custody, different visiting hours etc. based on the order of protection-by the way it is free.

amyhpete has a great answer too, if you have the funds. i didn't, so this was the easiest route for me. the public defender is who suggested it.

  3. o my god!!!! Call the POLICE RIGHT AWAY

  4. If I were you I would NOT SEND HIM ANYMORE TO SEE HIS FATHER and also contact your local child protective services center!!!!!  The most precious thing one has is their CHIDLREN!!!!!  If the sign are clearly there that something is wrong why would ou continue to send him??!!??!!  You dont want for it to be too late!  I hope everything works out for you and remember if YOU, as that childs mother, DONT speak up for him NO ONE WILL!!!!  Protect your baby!!!!!.....Good luck!

  5. I would call domestic relations, then I'd call CYS and ask for an emergency home visit to your ex's. What you described is in no way safe for any child and you can say you want overnight visits suspended until he cleans up his act.

  6. I be going to social services and the police (I'm in uk and its illegal to hit your kids or anyone Else's)  and id go to my lawyers and anyone else i could get hold of. The treatment your son is getting at his fathers is totally unacceptable. No court in the world would make me put my child in that diabolical situation.

  7. and you know this because you go into his house and actually look around or are you relying on a 2 year old to tell you, if you have actual proof then get some pics, but if you call somebody with no proof and it turns out to be a lie then you will look like a liar to the court

  8. I have been in theis situation and let me tell you that if you call social cervices do not mention to them that this is your ex. They will only think that you are a vendictive ex who is trying to get back at him. I would call my local police department and if that don't work get yourself a lawyer

  9. Call a lawyer right away to get a modification of the custody agreement. Your child will be assigned his own lawyer, called a guardian ad litem to investigate the environment of the two homes and determine the best course for custody. You could also call child protective services sometime while your child is over there but before you petition for the modification of custody and then when you do petition, the father's home will already be under investigation by CPS and you will have a better position and it won't be that they cleaned their house and put smiles on their faces after they received the petition but before the guardian ad litem made an appointment to speak to them.

That's what I would do. CPS will take photos when they go over there or at least notes. Then you will have a neutral party's opinion before you petition for the modification and like I said, they won't be able to clean their house and put smiles on their faces for the judge and start suggestion YOU are crazy. ;-)

Best of luck to you. I would call CPS the very next time your child goes over there.

  10. I would say you should call social services and th police soon! If you don't, god only know what will happen to your son!!!

Also try to get cusoty of your son.
