  1. Background check companies are also known as Consumer Reporting Agencies (CRA) and only reputable ones abide by the Fair Credit Reporting Act, which governs what can and cannot be done regarding background checks.

While I don't know which CRA does Office Max's checks, your daughter has a right to that information.  Furthermore, should anything be incorrect, she will have a right to dispute the information.  Usually a week is what you're given to dispute.  The CRA will then have to redo the check and make any corrections as necessary.  Furthermore, your daughter has a legal right to a copy of the report as well as to know what company Office Max used for the check.

Being as she's 20, unless she has an adult criminal record, you should be good to go.

  2. At my job, our background checks are done through the state police (VA).  I'm guessing that's where most background checks would go through since they would have a record of any prior convictions, plus they can look up in the system if you have outstanding warrants or anything else.  But, it also depends on how far the company does the checks too.  It could be something as small as a credit check to as detailed as their history with any felonies.

If the information is wrong, the business should contact the person they're doing the check on, and ask them for clarification on anything questionable.
