  1. It would be the Defendant since the officer has the burden of proof.


  2. If neither the officer nor the defendant show up in court, the case is typically dismissed as at least the officer must be there in order for the judge to issue a ruling.

    If the defendant doesn't show up their license will be suspended until they clear the matter.

  4. Let me say this for the 50th time.... YOU WILL NOT GET A CITATION DISMISSED because the officer WILL be there... period.

    In thirty years, I've never missed a court appearance, and I've only seen once or twice out of thousands that an office didn't appear in court... and there was a good reason.

    Now, if YOU don't show up, there will be a warrant issued for your arrest..
