Who gets in trouble more..the person working under the table or the employer?

Just curious :) My friend says the employer but I say the employee..What do you guys think.

  1. Well, when's the last time you heard a company shut down because they hired illegal immigrants?  Never.


  2. Employer gets into trouble. It's his responsibility to make sure he receives all necessary documents from his employee. Therefore, he gets in trouble. however, don't forget that the illegal immigrant will probably get deported.  

  3. The employer:  They lose licenses, get fined and have other consequences to their business.  The employee will just get a fine and have to find a new job.


  4. It's all evading taxes no matter how you look at it.

  5. The employer.  He can be made to pay back taxes both his share and the employee's share.  Employers are presumed to know a lot more about employment and tax laws than the employee.  The employee will also be forced to declare his income and file a return.

  6. if they are both prosecuted to the max it's tax evasion on both sides and most states can also get the employer on state charges that do not apply to the employee.
