Question:

Who has right of way here?

There are a few places in my residential neighborhood where there are crossroads with no stop signs either way. I always approach these with caution, slowing way down. No one else seems to do this; they just zoom on through without even slowing down. What are the traffic rules here? If there was a collision, who would be at fault?

  1. rule is look out...we have same in rural Virginia...every one either blasts through [kids] or sits there looking for 5 minutes...

  2. the car on the right goes first if they come up at the same time, it would be very hard to say who is at fault so just be carful

  3. When people come form perpendicular directions, the person coming from the right always has the right of way when there is no signage. If there are stop

signs, then of course the person from the right only gets the right of way if they stop at the same time.

In terms of opposite directions, the person turning left yields. If both cars are going straight or turning in opposite directions, they may go at the same time.

  4. As I have said many times... Right of way is not something you own. It's something the other guy gives you.

    Normally...

    1) at an uncontrolled intersection, or a four-way stop, the person who arrives at the intersection first has the right of way.

    2) If two or more vehicles arrive at the same time, then you should yield to the vehicle on your right.

    3) If two vehicles traveling in opposite directions on the same road reach an intersection at the same time, the vehicle going straight through has the right of way over the vehicle turning Left.

  5. Priority to the right is a right-of-way system, in which a driver of a vehicle shall give way to vehicles approaching from the right at intersections.

  6. if ur at a four way intersection and a car on the road on the right pulls up the same time as u they have the right away but if some one on the left pulls up same time as u u u have the right away its always the person on the right hase the right away!

  7. JetDoc is right.

That's all I need to say.

But I'm gonna say more anyway.

Traffic laws are written specifying which driver "shall yield right-of-way," not which driver "has" it.

At an uncontrolled intersection (such as in residential areas of Detroit), right-of-way is yielded to whomever got there first.  Unfortunately, this leads to some drivers just racing down the road without even slowing at an intersection.

And remember: right-of-way is of no use to a dead person.  If the rules say the other driver must yield, but he doesn't, let him have it.  It's not worth it.

  8. It supposed to be the driver to the right, has the right of way. But then it becomes the last driver who could have prevented it is at fault. Then it becomes a lawyers game and there goes the victims compensation.

  9. where are you, someone has a default give way to left or right, depending wich side of the road your country drives on. left for right, right for left.   it's not a first there first thru', it's give way to approaching traffic on your.... as described.   ignore it at your peril.   Sounds like someone is going to get hurt.

  10. I would saw if one road is more major than that would have the right of way. but really there should be at least one pair of stop signs somewhere. i would make your town or city government aware of thi issue.

  11. depends on if its public or private property, if private then its no fault but public it would be both at fault. If its on a public street call the city engineer and tell him to get a sign on the intersection.
