Who has the right of way in this scenario (australia)?

take this scenario...an ambulance is crossing an intersection with a red light to get to an emergency and person is driving a car and crossing that same intersection when it is a green light. the car driver is listening to an ipod so he cant hear the siren and its day time so the flashing lights aren't that visible.

If the ambulance hit the car, who's fault is it?

the cars because the ambulance was trying to get to the emergency or the ambulances because the car had the right of way and the ambulance should have been more careful?

  1. Thats a tough one. I would have to say the ambulance is at fault because even though they are allowed to run red lights they are required to do so with caution.

    The ambulance is at fault but the guy in the car is a frigging moron for not having his FULL attention on the road.


  2. The driver isn't supposed to be listening to their ipod.

  3. The car is at fault. The law says that you must give way at all times to emergency vehicles, when they have lights or sirens going. Not hearing or seeing them is not an excuse. The car driver could also be charged with driving with undue care because his hearing was impaired by the ipod.
