Who is at fault for a car accident i was just in?.?

I was driving on a back road and at a "t" I was turning left. I had my boyfriend and my little cousin in the car with me. I looked both up the road before i proceeded to turn. I didn't see anyone. I proceeded to turn and half way thru my turn my boyfriend yelled my name and I looked up to see a mini-van coming towards me. I stopped and the mini-van tried to swerve in front of me and hit the front passenger side of my car. The speed limit was 25mph and he was going WAY over that. My car did a 180 when he hit me. He took of my bumper, my hood was bent in half, i couldn't open the passenger door. I don't know who's fault it is. If he didn't swerve he would have hit the back passenger side of my car. SOMEONE PLEASE HELP!!!

  2. Sorry to hear that you were in an accident.  They are not much fun.

    It sounds to me that both of you could have been at fault.  Those turning left 'without yielding the right of way" always get ticketed. But if the other driver was going too fast, they should get one as well.   IMHO

  6. If you hadn't have pulled out in front of him, he wouldn't have swerved or hit you.

    Insurance company will decide, but based on the explanation, my guess is that you are at least 80% at fault.

    Did you get a ticket for failing to yield the right of way?

    If yes, you are likely 100% at fault.

  12. If the minivan was going straight and there were no stop signs, yield signs or traffic signal on either of your lanes, it would be  mostly if not completely your fault .  Sounds like you failed to yield the right of way to a vehicle that was going straight.  

    He swerved to try to avoid an accident but probably didn't have enough time to react.  He "could've" been speeding but unless you have any witnesses (besides your passengers) that saw the other driver speeding, it looks real bad for you (sorry).

    "I didn't see him" is not an acceptable excuse.

  16. How are you asking this question, if you were just in this car accident? did you wait for the police to arrive? They usually decide who was at fault once they arrive at the scene of the accident. Did you get a ticket? if you did they've already decided that it was your fault.
