Who is at fault for this accident?

If you are driving down the highway ( might be speeding a bit) and a long haul trailer pulls out from a stop sign and you hit the vehicle between the tows and kills you.....who is at fault. I am trying to find proof of this though.

The truck would be at fault for pulling out into traffic.

i would think it would be only an accident. the truck would be at fault for pulling out in front of you

The truck....if it was at a stop sign the driver is supposed to yeild to the Right-of-way

that is if the the person that killed was supposed to stop...if there was no stop sign or traffic light telling them to stop
