Who is at fault for this car accident?

i just recently got in a accident at a intersection with no stop sign either way. it is difficult for me to decide who's at fault because neither of us had to stop. the person that hit me came from the my right and i know that ur suppose to yield to the cars on the right however i do have a witness that said that i had the right away because i was more than half way through the intersection when he hit me. and also i was t-boned so it obviously shows that i was further in the intersection because other wise i would have t-boned him.

so who is at fault?

  3. The typical rule for an uncontrolled intersection is that each driver must stop and wait until it's safe to proceed (i.e any oncoming traffic has either stopped for you, or cleared the intersection).

    You have a good argument that if you entered first, you had control of the intersection and the other driver had the last chance to avoid the accident.

    Also, keep in mind that both drivers can be at fault. Most states will divide liability on a percentage basis: 60-40, 80-20 or whatever and apply what's called comparative negligence, meaning that (for example) if you're 60% at fault, you pay the other driver 60% of their damages.

  4. Finding out Who is at fault, is highly over-rated.  iF BOTH AUTOS WERE INSURED, WHAT DIFFERENCE does it make?  The police should have been called and then both insurance companies notified.  Let them sort out who was "at fault".

  5. The person on the right always has the right away and if you saw them coming and still went without obviously enough time to clear their way then you are unfortunatley at fault.

  6. If there is no stop signs at all no one would be at fault.  I do not see how there could not be a stop sign at either sides.

  7. It sounds crazy but there are some places especially in Texas that has no stops either way. Both are at fault if anything, not one or the other.
