Question:

Who is at fault here? and what should I do now?

Earlier today I was getting gas & I pulled out maybe 3 feet, and was hit by a car. I have a little Santa Fe & this woman was driving a 96 Dodge 3500...so it's like a cargo van & it left a huge dent in my brand new car! This is my first time in this situation so I didn't know what to do, so I was obviously shaken up & Iasked the lady if we should call the cops. She said that we didn't have to if it was a both at fault situation (which I felt a little sketchy about..) & she told me she was driving a company truck & her company could just write me a check. I took down most of her insurance & her # & I started to call my insurance agent to ask HIM if we should call the cops & the chick was like "Ok well you have my number, can I go then?"...but I WAS ON THE PHONE!

So, she leaves & I begin to leave & I realize my car is not driving right at all. I was on my way to work - I work at an airport 2 stoplights down...my wheel is completely jacked up!! and my car makes a screeching noise! I calle

  1. well actually you pulled out of the gas station lot and too far onto the main road and got hit then your at fault b/c the other drivers on the road have the right away and you went into the path of another car. sorry about your luck. you should have called the police to save the trouble of tracking down this lady. the cops would have taken care of it and explain who's at fault.


  2. Wait.. you sound at fault here?  Its pretty clear you pulled in front of her car.. am i missing something?

  3. it does sound like you are at fault, but the lady should not have just took off. she made it worse on herself by leaving. did the police issue a citation? It is totally up to the police and insurance co what to do next.
