Who is at fault in a parking garage accident?? ?

I live in California and was in a parking garage. I was in line to leave when another car backed into my car (my passenger door). Who is at fault? There is only damage to my car. I do not have insurance but the other driver gave me his information. I called and started a claim and they are waiting to contact their insured driver. Will I have to pay my own damages because I do not have insurance if it is not my fault?

  1. What were you doing driving without insurance anyway? Surely this is illegal anywhere, let alone California!


  2. It does not matter if you have insurance or not.

    The other driver would be at fault for this loss. His company would compensate you for your damages. Regardless if you have insurance, they are liable.

  3. They might not pay since it was on private property. I know that in the state of ohio, when ever you're on private property it's considered "no fault" unless one party was grossly negligent.

  4. The other driver will get in trouble because he was the moving vehicle. But you will get in trouble for no insurance.

  5. another car backed into my car.. you have the answer. who was driving other car was at fault.. but if your stae requires you to have auto insurance and you didn t and they hit your car anywhere its your fault for being with out i think yo uwil be ok they was backing up its their's

  6. person backing is ALWAYS at fault....they will pay...hope u got police report of its your word against theirs//or photos. [i always carry small camera in glove box
