Who is garnishing my wages?

All of a sudden my husbands check is garnished for 25%. We recieved no notice, his boss recieved no notice. The payroll dept have no idea who is garnishing and his credit report says nothing about garnishment. How the h**l do we find out who is garnishing his wages? Would we call equifax, trans, experian? Would they know? Im so pissed right now I dont even know what to do

  1. If the payroll department doesn't know, then they could not have started the garnishment.  Talk to them now and if htey cannot provide who started the garnishment, they need to stop and he needs an immediate check for the unpaid salary.

    I would check with the IRS just to make sure they didn't initiate something.


  2. I find it very difficult to believe that your boss, the payroll department, or anyone at his place of employment doesn't know who the garnishee is.  They have to send them a check for pete stakes!  

    It is also a legal requirement for the employer to notify  the employee in advance of garnishment to allow time for a dispute.  In Michigan that time is (I think) 20 days.  

    Also, you could simply call the court and get records of any judgments/court cases in his name.  They are public records.


  3. Payroll has to know whom is garnishing your husband wages. Ask the payroll manager to look into this matter. I think your husband has an idea who is garnishing his check and he probably did get the information and just did not inform you. Since it is your husband's paycheck and job some laws may prohibit (privacy laws) giving information to the spouse. You should request a credit report as soon as possible from all credit reporting agencies right away. Something smells a little fishy to me and your husband is holding the bait. Good luck.

  4. The payroll department would know. The payroll department would receive a legal notice requiring them to garnish the wages and send the payments to the party specified on the notice. The payroll department is the ones that cut the checks.

    No one can garnish the wages with out a court order and notice to the payroll department.

  5. You husband would be notified of who is garnishing his wages.  Perhaps he just doesn't want to tell you who or why.  Perhaps its for child support.
