Who is legally responsible for medical bills for a baby who's mother is only 16

can we send the account to collections under the minor's name? They reside in Virginia

  1. When you have a baby no matter what age you are you are consider an adult by law so the mother and father are always responisble for paying for the child.


  2. If they're not 18, it's their parents.  

  3. In general, a minor cannot enter into a contract (this is definitely true in Virginia).  The minor has the right to unilaterally cancel the contract.  However, if the minor does not cancel the contract and accepts services (such as delivery of a baby), then the contract can be enforced.

    The hospital will most likely go after the minor's parents.  Even if, legally, they cannot be responsible, their credit will be ruined until they hire a lawyer, go to court, and get a judgment for release from the debt.  At that point, they will have spent thousands of dollars.

    If the parents care about their kid, they'll assist in paying.  If they don't, then they can let their child and grandchild suffer.  It's their legal right.
