Who is liable for my driveway? it would be 2 different colors?

i had my home built with a concrete driveway, well the builders used bad concrete i have a three car garage. the concrete company sent a letter saying they would replace the driveway, now they only want to replace the driveway in front of the 2car garage door and not the 3rd..bcuz they say it not bad in front of the third car door. will a court make them do it all over

  1. have to agree with both of the previous answers.

    Two different batches created the problem but the integrity is probably good.

    sound like you and the contractor must work that out to your satisfaction.

    if defective or replaced, you could still end up with the same discoloration problem


  2. in my opinion,,,,,,,unless the concrete company gets the same amount of cement powder mixed in the aggregate, you ll see the difference in color.

  3. they are only obligated to replace WHAT IS DEFECTIVE as with most warrenties not because its different color  .... color has nothing to do with integrity ...... though your builder may have to replace it to make you happy

  4. If the difference is enough to detract from the looks of your home enough to devalue or make it less attractive to a potential buyer, it is enough to have them forced to do it correctly.

    A letter from your attorney may persuade them. You can also complain to the better business bureau, your local inspection services or the contractors bonding company. If you have local television news with an "on your side" segment, they can do wonders.

    To me this is no different than getting a bad paint job on your car. Two different colors is a material defect.

    What they want to do and what they have to do may be two different things. Make enough noise and you may not have to take them to court.
