Who is required to have workers compensation insurance?

I work for a doctor in private practice, and it's just me and another girl who works in the office. Is he required to offer workers comp?

  1. Any employer who has 1 or more employees is required to have workers comp... even if the 1 employee is part time.

  2. Each state has their own workers compensation laws.  Here in Texas, NO EMPLOYER is required to carry workers comp insurance.  Some states allow certain business types with less than three or less than five employers, to not carry workers comp.

    HOWEVER.  Not carrying workers comp, does NOT get an employer "off the hook" for paying medical bills and lost wages for workers comp claims.  In other words, even if the law doesn't require you to carry it, it WILL hold the business responsible, to pay the benefits themself.

  3. In most states it is enforced to have Work.Comp. If you're in the state of California, by law every employer must have Work. Comp for all employees. If you ever get injured on the job, or if he has you out doing his errands on the job and you get injured,  if he's uninsured you could sue your Doc. and the State will give him a huge fine!
