Who is resonsible for an adult with a permit in an accident?

Some who is the age of 18 or older and has a drivers learners permit and gets in an accident. Who is responsible the adult with the learners permit or the adult licenses passenger?

  1. The person with the driver's license is responsible.  The age of the permitted trainee is not at issue.  As far as suits go however, both the driver and the licensed individual can be sued.  If a trainee under 18 were to get in an accident and it was not a compensated instructor nor his legal guardian with him/her in the car the legal guardian could still be sued.

    The licensed passenger could sue the trainee driver also.  I was driving on a highway once, a drunk driver came over the center line and hit me head on.  I had two passengers.  one fractured his kneecap (very minor injury).  This passenger sued the other guy who's insurance paid.  He also sued me.  My insurance fought and won but, he still had the right to sue.


  2. Both would be responsible, they would go after the 18 year old first and if the accident was a big one then they would after the passenger, remember that the 18 year old is an adult....
