Who is responable for fixing a broken window befor closing that wasnt there when we said we would buy it?

When the inspector came to the house there was no broken window now 2 weeks later there is I just want to know if we havent closed yet who should be responable for the house? Shouldn't the seller have to fix something if it was there before we buy it

  1. The seller should fix it.  Most contracts are dependent on a home inspection being completed, so if they don't agree to fix the window you have the full legal right to walk away from the contract.


  2. If you haven't closed yet, the SELLER is responsible for fixing it.

    There is no question that they are responsible.

    PS:  Property condition reports are NOT used in the majority of the states.

  3. The property is to be in at least the same condition, or better, as it was when you went to contract.  Thus, a broken window is to be replaced.

    You have a property condition report that is part of the contract. If the window is not noted as being broken on that report, then seller needs to repair.

  4. READ YOUR CONTRACT.  Almost all provide that the Seller must deliver the property in substantially the same condition as when the contract was signed.
