  1. The registered owner, if the driver was not the registered owner then he/she would have to prove they had permission to be driving the vehicle.

If the drugs were on the person of a passenger they could additionally be charged with possession.

  2. The registered owner of the vehicle and or the driver.  It could also depend on who's person the drugs where found.

  3. usually the driver

  4. It Depends on the Time of Day, re: If the Morning shift the Police are normally very GOOD, If the Night shift Gets you then you are in trouble, The more point's the COPs get the better the chance they move up the ranks. also the person who has the finger prints on the drugs & if the driver has a Licence & he / she if the owner of the car, then they will have to pay for the Miss, however the more proof you have in writing or now days you have a video phone get it on camera & use it as evidence although it's admissible the court will still look at it & the police will change their mind once they know what you have as evidence against them re: getting pulled over the reason in the first place & the procedures following that action.

  5. Personally, to make it fair for everyone involved, I would charge the person who was the closest in proximity to the drugs.  This has been upheld by the U.S. Supreme Court.  However, if this person is adamant that the drugs do not belong to them and I believe this person or if no one else wants to take the blame, then the driver can easily be charged.  On a side note, it's wise to go ahead and take the blame if one is in possession of drugs.  If it is a small amount, you are probably only looking at a ticket and a court date.  This will of course depend on the officer.

  6. if drugs were found in the car the registered owner can be held partly in blame but usually the driver is held responsable it also counts on where in the car it was found, and who played the blame game.

  7. The driver.
