Who is responsible to pay for the broken toy?

My 8 year-old nephew was playing with a neighbor's child's remote control car (value-$15) and a car drove by and ran it over. Who is responsible to pay for the car?

  1. you have to pay for the toy because it was in your possession at the time it iwas damaged.

Given your updated info, I think since the neighbor child's mom was supervising your nephew at the time of the accident and presumably knew it was being driven in the street she should absorb the cost.  Had there been no such adult supervision I would think your nephew and therefore your sister would be liable.  I have stopped for remote control cars on my side-street before.  If I had been the driver who ran over that car I know I might feel at least partly responsible for it also depending on circumstance.  I don't think your nephew did too much wrong here other than having fun, can't effectively operate a remote car on a narrow path, accidents happen :-(.

  3. Which ever parent was watching the kids at the time of the accident and allowed them to play with it in the street. A grownup should realise that a car could come and squash the car, a kid may not.

  5. sorry this may not be what you want  to hear..but i would say tech your nephew.. he shouldnt have been playing in the street in the first place and second he should have been paying attention to his surroundings..if it was my childs toy i wouldnt make him replace it i would tell the boys its a lesson learned and they will take better care of their toys! hope that helped~

  8. i think that the newphew's parents should pay because he was the one who was playing with the remote control car on the road and the car ran it over so that's why the newphew's parents should pay

  9. It's a $15 toy - suck it up, replace the car make the kid happy again and forget it ever happened.

    If you don't like the solution then continued to be unreasonable and stop associating with this woman (and her kids) Geez.

Your sister is responsible.  Toy cars shouldn't be in the street, and your nephew was in posession of it.  I know how kids are, and if the neighborhood has a lot of them, it would be prudent for drivers to be more careful.  If your sister wants to keep a good relationship with your nephew's friend, I'd encourage her to pay for it.  Sometimes our desire to be right ruins the best of friendships.
