  1. the appeals system makes sure that a poorly judged case can be overturned.

    the highest court, the US Supreme court is checked by the system of checks and balances outlined in the constitution.  


  2. Actually, establishing precedent is a very arduous and lengthy process. Typically it is set at the appeals level, not in the original case. It does not happen at a whim.

    There is a legal principle known as "stare decisis." This means that the same legal rules used in prior similar cases should be applied to current cases. This is the exact opposite of creating precedent at a whim, and it greatly stabilizes the legal system. See the link below.

    As for who judges judges, some are elected (and are therefore judged by the voters). They are also are "judged" in effect by the appellate court system.

  3. They are suppose to follow the rules of the law.

  4. In a perfect world, checks and balances would be enforced and each branch would hold the others accountable but alas, they don't. Judges DO create law and often do not simply "interpret" law. Furthermore, as I alrady stated, said judges are RARELY if ever held accountable via checks/balances...
