Who knows how to appeal veteran benefits that has been denied?

I applied for benefits in january 2005 and was denied due to no medical records located. I received a v.a. enrollment form in the mail last week and completed enrollment. While there my case worker followed up on my claim that was made in 2005. We spoke to a representative and I was told that it was too late to appeal because it had been over a year. But then he said that The va received my medical records in 2007 and scheduled me for appointments which I missed in october 2007. He said that I can appeal those which are the exact same ones from 2005. I had not contacted anyone since january 05. The VA hadn't contacted me until now. My records showed up two years later. Why can't I appeal from 2005 if they are opening the claim up that I made in 2005? Please explain this to me. I'm so confused!!! What can I do? Will I be able to get paid from 2005 and not 2007?

  1. you talk about a case worker.  who?  is it a person from the VA?  i would suggest that you go see your county VA rep or better yet go to your nearest Disabled American Post and speak to one of their Service Officers.   you have rights that entitle you to appeals for the 2005 ruling.   The DAV has a proven track record of getting claims approved.   you will need to give the DAV power of attorney so that they can keep track of your claim.   one thing do not give up on the VA   It might take time but keep after it.   I have been waiting on a VA claim for almost two years and am still waiting.     ALSO YOU MAY GET BACK COMPENSATION FOR YOUR 2005 CLAIM

  2. Your denial letter should contain the instructions for an appeal.

    Take your letter to an American Legion post and ask for an Advocate to help you with that.

  3. You didn't say what benefits you are applying for. You need to talk to the VA Rep and don't miss appointments that are scheduled.

  4. Hmmm...The good olde VA two step...

    Sounds like you are dealing with all VA Personnel

    including your counslor...

    You need to get a Veterans Service Organisation

    representative...State/County Veterans Service Rep...

    It is a FREE service..

    You can not fight the VA alone...
