  1. The seller owns it unless the buyer demands that it be included with the sale.


  2. The easement appears on the deed of the land the right away is on, not who it is for.

    If you are buying or selling land that is accessed via a right away, which is an easement, it will not be recorded on your deed.

  3. A right of way only gives use of the property, not ownership.

    The person giving the right of way still owns the land. The person receiving the right of way does not own the land, only the right to use the land as specified in the right of way.

    A person can own a deeded right of way -- this is usually part of their property deed.  But they still would not actually own the land.
