Who pays for a deceased utility bills?

I had 2 roommates, a husband and wife. The husband and I are on the lease. The husband had the gas bill in his name. He passed away last month. His wife left to stay with her relatives. What do I do about the gas bill he had in his name? Is the wife responsible?

  1. Morally both you and the wife are responsible as you were both living there, but legally the gas company cannot claim the money from either of you as the bill was not in either of your names.


  2. I would return the bill to the utility company explaining the circumstances. It is for them to determine responsibility.

  3. The estate of the husband is responsible.  Assuming the wife inherited the estate, then she is the one who should pay.  

    In the short term, call the gas company and explain what has happened and see what you can do to work out the problem.  Clearly, you don't want the gas turned off in the meantime.  You may have to break down and pay the current bill and try to collect from her later.  You will need to have the account changed to your name if you plan to stay in the home.  (And put something in writing about the utilities with future roommates.  You might even ask for a deposit for last month's use.)

    Simply because the wife is responsible doesn't mean you will be able to compel her to pay.  (Even winning a small claims court judgement doesn't compel the loser to pay.)  

    The gas company will be unlikely to pursue her for the bill, so it comes around to you again.

  4. The wife is responsible for the bills left in his name, but in turn you have to get it put in your name. The lease now is all on you.
