Who should be responible when the snow plow has destroyed your mailbox?

If you live in a area where you get snow and the snow plow destroys your mailbox, who is responsible to get it fixed? Does anyone know who is? Is it your or the company that plows down the snow in your county, city etc?

  1. A lot of snow plowing of roads is run by the city or state.  Contact your local city or town council, they should know where to direct you.


  2. My brother's was taken out four times so far...and the county reimburses him for the new one.

    The last time was an inch of snow...

  3. The city should be but with the way that most cities are today, they will most likely do nothing for you.

  4. My box got whacked.

    The very next day someone from the county left a nice new 4 x 4 post laying in my yard. Well I figured that was not too bad a deal so I hammered a metal fence post into the ground and screwed the post to it. Instant fix. The box itself was not hurt so I could reuse it but if it had been crushed I would have called the county and  mentioned it to learn what they would say.

    In your case, at least call the office of either city or county to learn what their policy is. It would be hard to know if the heavy snow knocked it down or if the plow actually hit it. I wouldn't even barter that issue, if the plow driver is unwilling to slow down a bit at your mailbox then the county or city should be willing to replace it. Damage done is damage whether by the plow or snow from the plow. A friend had a car window knocked out by a rock from a lawn mower. The mower didn't hit his window, but the mower was responsible anyway. $400 to replace the window. People have to be held responsible for their behavior no matter what the conditions.

  5. Usually it is the company that's doing the snow plowing. They have insurance or post a bond to cover this as it's a requirement in the contract with the city or county that pays for it to be plowed. You will have to file a claim with them I suggest you take some pictures of the damage to enclose with your file there shouldn't be a problem getting paid for this as it happens all the time.

  6. most of the time you have to pay to get it fixed.  thats why most people either get real cheap or get indestrutable boxes...

  7. A snow plow is a motor vehicle and subject to the same laws as all motor vehicles. If it hit your mailbox (made actual contact with it) the driver and the owner of the plow are responsible for the damage! The driver can actually be charged with hit and run.

    If the mailbox was damaged by snow, that was pushed from the road, most likely the snow plow is not liable. If they did not hit the box, but just pushed snow into it and it fell. you will have to pay!

    If you are walking down the sidewalk in the rain and a truck comes by and splashes you with water, you have no recourse. If the same truck runs off the road and hits you, you would , of course, have a claim.
