Question:

Who to blame in bad weather accident?

This takes place in a parking lot. There are no stop signs in this lot and there are no traffic dividers separating 2 way traffic. It has just snowed/sleet about 2 inches and the roads are veryy icy.

I pull out of my parking spot and head north to exit the lot. As i am approaching the last parked cars i slow down to check if my left is clear of any cars going east so i can make a left. I am not able to see very well because of the heavy snow and blind spot on my left(last car parked is an suv). Next thing i know a car going east comes out i hit my brakes sending me into a slide right into the other car. The other driver did not attempt to stop at all. funny thing is i wasnt going any faster than 10mph and my car still went into a slid.

  1. If your smart enough to ask this question, your smart enough to have let the traffic through, before you proceeded.

    In crappy weather driving, the rule is to expect the other guy

    and go on defense.

    I don&#039;t know..pay half and move on...small accidents keep you aware for the big one

  4. in bad weather. every driver should pay more attention. going to fast is the fault.

  5. Unfortunately, I have to agree with JetDoc. It was your fault for not being careful and alert. You caused the slide and the accident. It was your fault for hitting the parked car. Don&#039;t blame anyone else. Also in those conditions, any car can slide even at 5 mph! Be more careful next time.

  8. Kind of no ones fault unless you can prove he was going fast in bad weather  (reckless/endangerment).

It would be 50/50 &quot;if&quot; the other driver were speeding but on technicality, if he were going straight,  it would be your fault because for one, you failed to yield right of way,  you failed to maintain control of your vehicle AND it&#039;s hard to prove the other driver was speeding unless you have witness who saw him speeding.  

    The weather is just that, the weather.

  15. If I had to call it, I&#039;d say you were responsible. The traffic going E/W are a thoroughfare and it&#039;s up to you to merge/enter. It sounds like the other car was going fast and that is a problem. There is a thing called a no-fault accident but I&#039;m not too sure what that&#039;s all about.
