Who would win this case.?

ok so lets say there are two cars at a 4 way and both cars are going to the same street but driver 1 accidently goes before number 2 even though number 2 had the right of way. so 1 realizes it was number 2's turn and brakes half way through the 4 way but notices that its no late and has to keep going.. and number 2 is irritated at number 1 for going first.. and so he keeps tailgating him real close...and then at a stop since number 2 was so close hit rear ends number 1.. who would be held responsible for the reck? driver 1 or driver 2?? please answer thanks

  1. number 2 is at fault for following too closely. it is illegal to tailgate. tailgating is not the brightest way to resolve that issue.

If someone rear ends someone else, it is almost always their fault.  There are exceptions, such as someone is in reverse and a few other rare cases, but it is assumed that the one whom rear ended the other is at fault.  Additionally, tailgating lead directly to the accident and that is illegal.

    Driver 2 would be to blame.

  4. This would be #2's fault regardless of being cut off. He was following too closely and tailgated, and then rearended #1. Driver #2 takes sole blame.

  5. Any car that rear ends another is the one at fault. By tailgating this person is showing what they call road rage and is alone a reason to be held at fault. Thus, car number 1 would win.

    Check your rules of the road handbook for your State , I am sure they have the rules posted on their website.

  6. Driver #2 is legally responsible for the collision due to not having his vehicle under control (following too close). Nothing else is relevant.
