Whos fault is it when someone runs a red light at an intersection, causing a collision?

The traffic light has turned green for me and a car at the intersection runs through a red light going across my path. I break my car really fast and hard to prevent crashing in to it, but the car behind me couldn't break fast enough and hit my car, who's fault is it and who pays for it?

  1. I believe the blame should go to the driver who ran the red. If they fail to stop and you have no way of tracing them, then the blame will be apportioned to the person who ran into the rear of the first car.

    You may also want to see if the intersection has a red light camera.


  2. In any rear-end collision between two cars, the one at the back is responsible due to not leaving enough of a gap to stop safely in the event of an emergency braking situation.

    The moron who ran the red light did CREATE the situation that led up to the accident, but he isn't responsible for the actual crash itself.

    ticket and you can win this one in court and your insruance will not pay. you can make all calins on the person taht ran the light;

  6. At fault,  truly,  is the clown that ran the light.       I understand that you missed it,  and they got away scott free unless there were witnesses or camera to prove that they ran the light.

    The other car hit you.   Following too Closely can be defined as too close to allow sufficient time to respond to circumstances in front.    He hit you in the tailpipe,  he was following  too closely.    He needs to pony up.

  7. She failed to yield to oncoming traffic. That's why you don't admit guilt. If all don't testify in a court case she walks away.

NO matter what, it has to be you to fight for your rights.  I learned the hard way.  It is not acceptable, yet that is howit is unless you get a helpful cop, fight to get it right.  It is worth it in the end and helps to make change in our defective society.  Do your best, get the reports right down to the last scrap of paper.  You will be surprised at what you might find, you might now.  I sure was when it was in my case.

  11. the golden rule..when someone hits the back of your car, it is always the other person's fault.

    Going by this rule, it is definitely not your fault and there is not enough evidence to prove that the girl ran through the red light.

  12. The most ignored part of the drivers manual is the part about paying attention to what is in front of you and keeping a safe following distance. The person who ran the light was the first person to cause the problem but the person who hit your vehicle was also wrong for not allowing a safe distace between your vehicle and his or he took his attention off of his driving. This is the law but it is rarely if ever inforced due to the imposibility of proving the intent of the driver. I get cussed and fingered a lot for taking my time at an intersection, but I have been hit by a lady who ran a stop sign so now I take the extra second or two at the intersections.

  13. Sounds like the fault of the person who hit your car.  He/she wasn't paying attention.  I try to keep about two car lengths between me and the car in front.

  14. the person that hit you is t fault, no matter how you slice it. they have hit you and no matter what the circumstances are unless they can prove you were acting in a dangerous manner, the fault will still be on them
