A judicial system is there to be fair to both the accused and the victim!  It does not violate anyone's rights!

Our criminal justice system is set up to protect the accused.  Innocent until proven guilty, probable cause, due process, trial by jury, evidence beyond a reasonable doubt.  There are reasons the system is set up this way.

Are the victim's rights served if the wrong person is arrested and jailed?  Of course not.

The victim's sensibilities are very important in the criminal justice system.  They have a right to see justice done.  But the law cannot 'satisfy' the victim's rights at the expense of the rights of the accused.   We can not arrest, convict and jail a person without probable cause and due process.   When the system can't meet those burdens then criminals go unpunished.  That is an injustice.  But without due process, then those in power can do anything they want to those without power.  That would be a far greater injustice.

The rights of the victims are usually violated because they are even subjected to caprices of media even when they already sufferred from the whims of the accused.

both because it is not really a justice system it is based to much on what mental health and psychiatry says now, it is basically for sales and marketing now
