Question:

Whose responsibility is it to fix a leak in a pipe in bathroom wall if contractors workers did it?

We had our home built 5 years ago. The children's bathroom, located between our two children's bedrooms, apparantly has had a very slow leak in the plumbing since day 1. We didn't notice a problem until a few months ago. The wall right near the tub has a spot on it a few inches long where it looked like the paint was bubbling and the baseboards in that area were starting to crack. I got curious and ran my finger up and down the bubbly spot and the paint chipped off before my eyes and I could see black moldy looking stuff on the wall. I guess it took so long to show a problem because the leak is apparantly a very minor one, and that bathroom is not used on a daily basis, being as we have a master bath with another tub and shower. Anyway, we had somone look at it and they said it looks like when the workers nailed our linen closet into the wall, they drove a nail into a pipe. Whose responsibility would this be? Appreciate advice, please from anyone who would know. Thanks so much.

  1. A quick and easy way to fix the leak is to put some rubber, like from an inner tube, around the leak and clamp it with a hose clamp.


  2. the peopl that did it but good luck trying to collect also the plumbers should have put pieces of metal were the pipe went threw the studs so dry wall screws or nails wouldnt punture them

It would probably be the people who built the closet, but if this was done when the house was new, it is very unlikely the builder will cover it.  Most builders have a one year builder's warranty, but your state may have different rules for how long they must cover problems.  If it is as you say, you can ask the builder if they will fix it, but don't hold your breath.  Also, if the closet was put in after the fact, you could contact them and see if they will repair the damage.  

    Whatever the case, make sure whoever fixes it gets all of the mold.  To do that yourself, spray it down with a bleach & water solution to kill it, and then clean it off of the wood.
