  1. I would think she MUST return it to you on the last day of school.

No teacher wants to keep your phone and would always return it to you (or to your parents if that was appropriate).    You should be more considerate of others and make sure that you do not put yourself into the position where you have to have your phone removed from you.   Surely you do not switch it on/and or use it in class.   You should use your phone responsibly and no one would have to remove it from you.   Most British schools have a rule that phones should not be switched on in class as it is so disruptive of other pupils' education!   (Hope this is a rhetorical question and that your teacher has not permanently confiscated your mobile!)

When I went to high school I was told they can't just take it.  They have to ask you first and if you say no they'll just refer you to the deans.  If you do give your cell phone up they would give it to the deans and you would have to pick it up after school.  Either way you would visit the deans at my school.  But if I teacher kept your phone forever, can you imagine how mad the parents that pay for that phone would be?

  5. why cant u respect EVERYONE ELSE and turn it off. if international company presidents and world leaders can make-it through meetings, a child can make it through a school day.

She can do what is necessary to keep order in her class.  Since the phone is your property, she must give it back to you ... sometime.  However, if you hadn't been disturbing the class with it in the first place, it wouldn't be in her hands now.  I suggest you go to her after school, tell her that you are sorry that you disturbed her class, promise her that you will not bring the phone to school again, and ask her if you might take it home with you.  Then leave it at home!!

  7. Due Process.

    You have to be guilty of a crime for which the penalty is forfiture of the cell phone.  She can not keep it without justifying the reason.  There are laws on the books that involve forfiture of property for certain offenses, but the constitutionality of many of these laws is questionable.
