Why cant the holocaust survive as an historical fact without the threat of prison, fines and deportation?

well, in germany, belgium, france, poland and austria you can be put in jail of you deny or downplay the holocaust. it used to say that 4 million people died in auschwitz, but now it is said that only 1.1 million died there. but if you say that even less were killed there you can go to jail. isnt that absurd?
