  1. First off the idea behind the consititution was to make three co-equal branches each being able to checl and balance the others.

    Congress- Approves judges - override a presidential veto

    President- pardon - executive order

    Judges -   judicial review of both branches

    But Thomas Jefferson persoannly belivied they made the judges the strongest branh as expressed in his letters.


  2. Because it represents the people, and the one branch which represents the people needs to have the most power, since power ultimately cannot be trusted in the hands of just a few people.

  3. Yes it represents the people and was also the model they had from Parliment in England. Some of the founding fathers feared the office of president and I believe that Ben Franklin thought that including the office of President was a mistake. The judicial branch of govenment really had little power until it cut out a role for itself in the case of Marberry vs Madison which stood for the premise that the Supreme Court has the authority to review laws.

  5. I'm sure they envisioned that any branch could wield unbalanced power so they went about assigning checks for each branch over the other two in an effort to make sure that, as long as each did there job, no one branch could bully the others.

  6. They didn't.  The Founders created three branches of government --Executive, Legisative and Judiciary.  All three serve as checks and balances on each other.  None of them is stronger than the others.
