Why did the Supreme Court allow the case filed by Paula Jones against President Clinton (Clinton v. Jones, 520 U.S. 681 (1997) to go forward, while it did not allow suit against President Nixon in Nixon v. Fitzgerald, 457 U.S. 731 (1982)?

  1. Probably because the two are distinguishable, and because of the conservative nature of the court.  Fitzgerald lost only on his challenge to absolute Presidential immunity.  The activities complained of were reasonably related to official acts within the ambit of the duties of the Presidential office.

    The Jones case involved activities while Clinton was governor of Arkansas, and had no relation to his Presidential status.  In addition he had a well known sordid history, and the court remains conservative.  Clinton and his wife are both reasonably competent lawyers and understood that the conduct complained of had no possible claim to executive immunity, but it was a fine stalling tactic.
