Why do I have to get married to get the benefits?

can't I just sign a domestic partner agreement, defining the nature and obligations of a relationship by agreement. An existing domestic partner written agreement should be suffiient enough for two responsible adults who want to buy a property together or benefit their lives some way right?

  1. In almost all situations, you can hire a lawyer to create legal documents which explicitly define the responsibilities and legal obligations of both parties with regard to any type of joint venture.

    And, if the domestic partner doesn't live up to the terms of this agreement, he can be sued in civil court.

    To me, the financial obligations and potential losses which may occur in this type of agreement are much less grievous than what may result from a typical marriage agreement.

    Don't worry; if the marriage goes sour, you will see your hubby in court anyway.


  2. That depends on the state you live in mostly.  And in most states you are much more protected by law if you are married.  

    If you are a domestic partner your other half can throw you out with out giving you your share of any property.  I've seen it happen in two states, michigan and Ill.  The sad thing is the partners all say 'oh that won't happen to me'  it did.  The worst is losing private personal momentos.  That's what made one male friend cry.  Because he couldn't get some personal property back from his ex-DP.
