What would you do?

You get into an accident someone rear ends you and you get to give the police everything but they dont take your statement just everyone elses and he tells you he doesnt have to. Also he hit my car and all I got treated like by older people is punk 23 year old stero typed but im just nice guy and mature for my age, the other guy was angry and hostile. I tried the whole time being mature as possible just to get treated like an idiot for simple rear end collision.

Why wouldnt he take my statement and ignore me and my damage?

I would like to add I have no accidents or tickets since I have been driving.

I did get his badge number and name

I got pictures of cars and skid marks showing we where in same lane contradiictary to him saying I switched lanes then he rear ended me.

  1. Because Mono Typing doesn't allow for PANNING

  2. If you were rear-ended, it is correct; He doesn't need your statement. Regardless of How or Why it happened, the guy who hit you was wrong. My wife recently got rear-ended. Her statement wasn't taken either. The cop said it wasn't needed.

My worry would be that you say you got skid marks showing you were inthe same lane. You skidded to a stop? That could be an Insurance issue, but it doesn't matter to the cop. The guy was following too closely if he rear-ended you.

The National Safety Council recommends a minimum three-second following distance with an additional second for adverse or hazardous driving conditions, like heavy traffic and poor weather and visibility. If your speed is higher than 60 miles per hour, you will need to add extra following distance between the vehicle ahead and your vehicle. The higher the speed, the more distance it takes to stop your vehicle.

  3. Answer from a General Insurance Agent

Just Relax and Don't worry about it. You have insurance and you did everything right, The insurance company will investigate and handle the matter for you.

The police report does not determine your liability. The officer for whatever reason did what he did. Maybe he was just trying to calm the other irate driver before it was necessary to arrest him, Maybe prejudiced, maybe incompetence or maybe he had just prior to this incident had an altercation with another less responsible young person, who knows? The world is often unfair and life comes with no innate guarantees of fairness or justice. There is no sense in worrying yourself sick over it

If you were hit squarely from the rear, then 95 percent of the time, the trailing vehicle will be found liable in a rear end collision. This is because the trailing driver had a responsibility to maintain enough distance, generally one car length per 10 miles per hour of speed for exactly this purpose. Had the trailing driver maintained the proper distance he would have been able to stop in time and could have avoided hitting you.

Just be honest and give your Insurance company an accurate report of what happened along with the photos you took.

Although the police report will be used in your Insurers investigation of the accident, the claims adjuster has been trained in these matters and will make a decision based on all the facts, not just solely on this police report.

Your Insurance company knows that the officer did not witness the accident, he arrived well after the fact. Most likely your insurance company will deny any claim from the trailing driver due to "following too closely".

If you have damage to your vehicle you need to contact the other drivers Insurance Company and file a claim for repair of your vehicle.

    Take care and good luck
